Terms of Use

Welcome to the AICPM website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern AICPM relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.
1. The AICPM SERVICE
The Service is an online application, containing a wide variety of information and data provided by AICPM and/or posted on the Website by users of the Service (‘content’).
2. REGISTRATION
2.1 To take advantage of the full Service, users must register with AICPM. By registering you confirm that all information required in the registration process will be supplied and that this is accurate, and that you will update the information as necessary to ensure that it remains accurate.
2.2 Information supplied in the registration process, as well as other information provided to AICPM during your use of the service is governed by Namibia Expertise International’s privacy policy.
2.3 Members of AICPM are issued with a password. You are responsible for maintaining the confidentiality of your password and you are recommended to change the password on a regular basis.
2.4 You must not disclose your password to anyone who is not an employee of AICPM.
2.5 If you learn of any unauthorised use of your account or password, you agree to notify AICPM immediately.
3. ONLINE BOOKINGS
When booking to attend events members of AICPM will only benefit from members’ rates if they have logged in.
4. EVENT BOOKING CANCELLATION POLICY
4.1 All fees are payable in advance of the event. Should you be unable to attend an event, a substitute is welcome at no extra charge. Guests may be refused admission if payment is not received prior to the event.
4.2 AICPM regrets that they do not normally refund should you cancel after the closing date for the event.
4.3 Please AICPM with any cancellation notice. All cancellations must be confirmed in writing, even if details have been given by phone.
4.4 If you find yourself unable to attend on the day of the event itself, please telephone AICPM to ensure that we can make the necessary administration changes on the day.
5 CONTENT ON THE WEBSITE
5.1 You acknowledge that AICPM is not responsible for, does not pre-screen, control, endorse or verify the Content posted to the Service or available through the Service, and that it makes no guarantee regarding the reliability, accuracy, legitimacy or quality of any such Content. You agree that you will bear the entire risk of reliance on the accuracy, validity or legitimacy of any Content.
5.2 AICPM shall have the right (but not the obligation) to access any bulletin board or other part of the Website and remove or restrict access to any Content on the Service in its sole discretion and without notice or compensation.
5.3 AICPM may preserve or disclose any Content if it reasonable believes this is required by law or in the good faith belief that such preservation or disclosure is reasonably necessary to protect the rights, property or personal safety of AICPM, its users and the public.
6. MATERIAL SUBMITTED BY YOU
6.1 By communicating with the Website and by submitting information and data, you confirm that you:
(a) have all necessary legal rights, including, without limitation, intellectual property rights to the material you send to the Website and that no contractual or legal rights of any third party will be infringed or adversely affected;
(b) take full responsibility for all material you send to the Website;
(c) will not send any unlawful, confidential, defamatory, obscene, threatening, sexually or racially offensive, abusive, harmful or otherwise objectionable material; and
(d) will ensure that nothing sent by you contains software viruses, Trojan horses or any other computer code, files or programs which may interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications.
6.2 If you commit or permit a breach of any of the above, you will keep AICPM fully indemnified against all liabilities and claims arising out of your actions and AICPM may, at its sole discretion terminate you AICPM your password, account (or any part of it) or ability to use the Service, and remove and discard any Content within the Service.
6.3 You grant AICPM the world-wide, royalty free and non-exclusive license to reproduce, modify, adapt, distribute and publish any material that you submit, for the purposes of display on the Website.

7. ONLINE FORUM
In using the Service to create or make accessible a bulletin board, you agree to use your best efforts to ensure that individuals posting Content to the board comply with the requirements of this Agreement, and you agree to take action to remove or disable access to any Content on the board that violates any of the provisions of this Agreement.
8. USER DISPUTES
You are solely responsible for your interactions with other users of the Service. AICPM reserves the right, but has no obligation, to monitor disputes between you and other users of the Service.
9. AICPSCM COPYRIGHT & NO RESALE OF SERVICE OR CONTENT
9.1 All copyright and other intellectual property rights in the Website and all material and Content prepared by AICPM is the property of AICPM (or licensed to AICPM) and no rights are given to you in respect of the same except as specifically stated in this International Agreement.
9.2 You agree not to download, reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, anything covered by the previous paragraph or your use of the Service, access to the Service or any of the Content accessible through the Service, other than Content as to which you hold the intellectual property rights.
10. RULES REGARDING SERVICE
10.1 You agree that AICPM may establish, in its sole discretion, any rules concerning use of the Service, including, for example, the maximum number of messages a user may post to a given board or the Service in a given day, the number of days that posted messages will be available, or the maximum size of a given post.
10.2 You acknowledge that AICPM has the right to change these rules at any time, in its sole discretion, with or without notice. You and those authorized by you will comply with all rules in force.
11. MODIFICATION AND TERMINATION OF SERVICE
11.1 AICPM reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without notice. You agree that AICPM shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
11.2 You agree that AICPM, in its sole discretion, may terminate your password, account (or any part of it) or ability to use the Service, and remove and discard any Content within the Service, without having to give any reason. You agree that any termination of your access to the Service may be immediate and without prior notice. You further agree that AICPM shall not be liable to you or any third-party for any termination of your use or ability to access the Service.
11.3 AICPM reserves the right to take any action it deems necessary with respect to your AICPM or user account if we have reason to believe it may cause us to lose the services of our ISP or suppliers.
12. LINKS TO OTHER WEB SITES
Links to other websites are for convenience only. You agree that AICPM has no control over any such links, does not endorse and has no responsibility for any aspect of those other websites, their content or products.
13. DISCLAIMER OF WARRANTIES
You agree that:
(a) your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis.
(b) AICPM gives no warranties and expressly disclaims all implied warranties to the fullest extent permitted by law including, but not limited to, the implied warranties of merchantability, fitness for purpose and non-infringement;
(c) AICPM gives no warranty that (i) the Service will meet your requirements, or be uninterrupted, timely, secure, or error-free, or (ii) that any Content or advice or information that may be obtained from the use of the Service will be accurate or reliable; and
(d) Any material downloaded or otherwise obtained through the use of the Service is obtained and used at your sole risk and discretion and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
14. LIMITATION OF LIABILITY
You expressly agree that, to the extent permitted by law, AICPM, shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of contracts, profits, goodwill, use, data or other intangible losses (even if AICPM has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; or (v) any other matter relating to the Service or the website. Liability for personal injury or death will be in accordance with the law.
15. INDEMNITY
You agree to indemnify and hold AICPM, and its members, affiliates, officers, agents, employees, and contractors harmless from any losses, damages, cost and expenses, including reasonable legal fees, suffered or incurred as a result of any claim, demand or proceedings by any third party arising out or in connection with any action or inaction on the part of yourself or anyone for whom you are responsible including, but not limited to, any Content you submit to the Service, your use of the Service, your connection to the Service, your violation of the law, this Agreement or the rights of any third party.
16. NOTICES
Notices to you may be given via email, regular mail or airmail. Notice sent by email will be deemed received on the date of transmission. Notice sent by regular mail will be deemed received two working days after posting in the Africa, five working days if sent by airmail. AICPM may also give notice of changes to this Agreement or the Service by displaying notices or links to notices on the Website.
17. GOVERNING LAW & DISPUTES
This Agreement and your relationship with AICPM shall be governed by the laws of Namibia. You and AICPM agree to submit to the exclusive jurisdiction of the English courts.
18. AMENDMENT TO AGREEMENT
AICPM may amend this Agreement at any time by posting the amended terms on our site at AICPM. All amendments shall automatically be effective on the date specified in the notice or, if none, 30 days after they are initially posted on our site. Your use of the Service following the effective date of any modifications shall constitute your binding acceptance of those modifications. This Agreement may not be otherwise amended except in a writing signed by an officer of AICPM.
19. GENERAL
19.1 This Agreement constitutes the entire agreement between you and AICPM with respect to the Service and supersedes all prior agreements and understandings between you and AICPM concerning its subject matter.
19.2 AICPM’s failure to enforce any provision of this Agreement will not be construed as a waiver of any provision or right.
19.3 In the event that any provision of this Agreement is held in whole or in part to be invalid or unenforceable, the invalid or unenforceable portion will be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions will remain in full force and effect.
